1. Agreement to Terms

By accessing or using camperfriends ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Platform Description

camperfriends is a peer-to-peer marketplace that connects camper van owners ("Owners") with renters ("Renters"). We facilitate bookings but are not a party to rental agreements between users.

3. Eligibility

You must be at least 18 years old to use camperfriends. By registering, you confirm that you meet this requirement and have the legal capacity to enter into binding contracts.

4. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• We reserve the right to suspend or terminate accounts that violate these Terms

5. Owner Responsibilities

If you list a camper van on camperfriends, you agree to:

• Provide accurate descriptions, photos, and availability
• Ensure your vehicle is roadworthy, insured, and legally registered
• Maintain adequate insurance coverage (liability, comprehensive, and collision)
• Disclose any vehicle defects or issues before rental
• Comply with local laws and regulations for vehicle rentals
• Respond to booking requests within 24 hours
• Honor approved bookings or face potential account penalties

6. Renter Responsibilities

If you rent a camper van on camperfriends, you agree to:

• Possess a valid driver's license appropriate for the vehicle type
• Use the vehicle responsibly and in accordance with the Owner's guidelines
• Return the vehicle on time and in the same condition as received
• Report any damage or issues immediately to the Owner
• Comply with all traffic laws and regulations
• Not sublet or share the vehicle without Owner's explicit consent
• Pay for any damage, fines, or fees incurred during the rental period

7. Platform Commission

camperfriends charges a 15% commission on all confirmed bookings. This fee is automatically calculated and deducted from Owner payouts. The commission covers:

• Platform maintenance and hosting
• Payment processing
• Customer support
• Fraud prevention and security

8. Booking & Cancellation Policy

Booking Process:

• Renters submit booking requests with desired dates
• Owners have 24 hours to approve or decline
• Approved bookings are confirmed via email

Cancellation by Renter:

• More than 7 days before rental: Full refund minus 10% processing fee
• 3-7 days before rental: 50% refund
• Less than 3 days before rental: No refund

Cancellation by Owner:

• Cancelling confirmed bookings may result in account penalties
• Repeated cancellations may lead to account suspension
• Force majeure exceptions apply (natural disasters, vehicle breakdown, etc.)

9. Payment Terms

• All payments are processed through secure third-party payment providers
• Prices are listed in Swiss Francs (CHF)
• Renters pay upfront upon booking approval
• Owners receive payouts within 5 business days after rental completion
• camperfriends is not responsible for payment disputes between users

10. Insurance & Liability

Owner's Insurance: Owners must maintain comprehensive vehicle insurance that covers peer-to-peer rentals. camperfriends does not provide insurance.

Renter's Liability: Renters are responsible for any damage, theft, or loss during the rental period. Additional insurance may be purchased through third-party providers.

Platform Liability: camperfriends is a marketplace platform only. We are not liable for:

• Vehicle condition, safety, or roadworthiness
• Accidents, injuries, or damages during rentals
• Disputes between Owners and Renters
• Loss of personal property
• Failure of either party to fulfill rental obligations

Our maximum liability is limited to the platform commission paid for the booking in question.

11. Prohibited Uses

You may not use camperfriends to:

• Post false, misleading, or fraudulent listings
• Engage in price manipulation or bid rigging
• Harass, threaten, or discriminate against other users
• Violate any local, national, or international laws
• Scrape or copy content without permission
• Circumvent platform fees by transacting off-platform
• Use vehicles for illegal activities (smuggling, drug transport, etc.)

12. Dispute Resolution

In the event of a dispute between users, camperfriends may provide mediation assistance but is not obligated to resolve conflicts. If mediation fails, disputes must be resolved through:

• Good-faith negotiation between parties
• Binding arbitration (if both parties agree)
• Legal action in Swiss courts (jurisdiction: Zürich, Switzerland)

13. Intellectual Property

All content on camperfriends (logos, text, graphics, software) is owned by camperfriends or licensed to us. You may not reproduce, distribute, or create derivative works without written permission.

By uploading content (photos, descriptions), you grant camperfriends a non-exclusive, worldwide license to use, display, and promote your content on the Platform.

14. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Receive multiple user complaints
• Fail to respond to platform inquiries

You may delete your account at any time by contacting camperfriends@polsia.app.

15. Disclaimer of Warranties

camperfriends is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy or reliability of user-generated content
• Security against unauthorized access
• Availability of specific vehicles or dates

16. Limitation of Liability

To the maximum extent permitted by law, camperfriends is not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from user conduct or vehicle condition

Our total liability shall not exceed the platform commission paid for the relevant booking.

17. Indemnification

You agree to indemnify and hold camperfriends harmless from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes between you and other users

18. Governing Law

These Terms are governed by Swiss law. Any legal action must be brought in the courts of Zürich, Switzerland.

19. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of camperfriends after changes constitutes acceptance of the updated Terms.
